Fondazione Benvenuti in Italia and Acmos Aps (“Joint-Controllers”), acting in the capacity of Joint-Controllers” in compliance with Art. 13 of the EU Regulation 2016/679 (“GDPR”), inform you that your Personal Data will be processed for the following purposes and through following means:

  1. Purpose of Data Processing

Data Processing is carried out by the “Joint-Controllers” within the scope of their activities. In particular, your Personal Data will be processed with the support of electronic and other means for the purposes of using, preserving and publishing photographs, audio recordings photographs and messages transmitted by data subjects participating in the “EURECA” campaign;

The legal basis for Data Processing of this kind is the consent of the Data Subject.

Your consent is optional. Should you refuse to express your consent for Data Processing, you will not be photographed nor recorded. You can also withdraw the consent to the Data Processing at any time without prejudice to the lawfulness of the processing based on the consent expressed before the revocation.

Moreover, your data may be processed for the following processing activities:

A. enable you to make a donation or to request an EURECA kit;

B. acquire statistics and metrics that contribute to maintaining the correct functioning of the Website;

C. exercise the rights of the Website’s owner (for example the right to defense in court).

The legal basis of the Data Processing is:

In relation to purpose A, the Data processing is necessary for the execution of a contract between the Data Controller and Website’s users, and/or for the execution of pre-contractual measures adopted upon request of Website’s users;

In relation to the purposes B and C, the legal basis is a legitimate interest of the Data Controller, that is to monitor the correct functioning of the Website and exercise the rights of the Data Controller.

The provision of data for the purposes listed above is optional. If you decide not to provide the requested Data, it may not be possible for you to interact with the Website. Upon your interactions with the Website, your Personal Data may be processed through the use of cookies. Complete details on the cookies used are provided in the Cookie Policy.

2. Data Processing methods

The Data will be processed by the Joint-Controllers with electronic and other means according to the principles of lawfulness, fairness and transparency provided for by the applicable legislation on the protection of Personal Data. Your confidentiality will be protected through technical and organizational security measures that ensure an adequate level of data security.

3. Data retention period

Unpublished photos and messages may be preserved for a period not exceeding 24 months.

The data concerning the donations will be stored for 10 years.

4. Communication, dissemination and transfer of Data

The Data will be processed, exclusively within the limits of what is necessary, by the personnel trained and authorized by the Data Controller as well as by the personnel of third parties who provide services to the Data Controller and carry out Data Processing on behalf of and on the instruction of the latter, in the capacity of Data Processors.

In case of communication of the Data to third parties, the recipients may be:

a) Individual or associated consultants and freelancers (for example photographers, graphic designers and web designers);

b) Websites and hosting services;

c) Cloud services and management software;

d) Social media;

e) Other Data Processors appointed by the Data Controller.

Concerning the donations, the data may be shared with payment providers and public institutions to which the communication of data is required by the law.

The Data Controller may transfer the User’s data to countries outside the European Union. The Data will be transferred exclusively to countries deemed appropriate by the European Commission or to companies that meet the guarantees provided by Articles 44 – 50 of the GDPR.

The Data Controller has signed a joint-controllership Agreement pursuant to art. 26 with other partners of the campaign. The designated point of contact with data subjects is Fondazione Benvenuti in Italia.

5. Rights of the Data Subject

The Data Subject may exercise, in relation to the Data Processing described therein, the rights provided for by the GDPR (articles 15-22), including:

a) Access rights – receive confirmation that your Data is held by the Data Controller, and access its content;

b) Right of rectification – update, modify and/or correct your Data;

c) Right to be forgotten and right to limitation – request the cancellation of Data and/or limitation of the Data Processing if you believe that your Data is being processed in ways that do not comply with the present Privacy Notice;

d) Right to object – oppose the processing of your Data;

e) Submit a complaint to the relevant Supervisory Authority – the Guarantor for the protection of Personal Data (accessible on www.garanteprivacy.it) in case of violation of the regulations on the protection of personal data;

f) Right to Data Portability – receive an electronic copy of the Data concerning you (when such Data has been rendered in the context of the contract) and request that the Data in question be transmitted to another data controller.
